Analysis
JUAN C. LEAL AND VICTORINA O. LEAL have requested a license to cross a platted easement (See attached Exhibit “A” plat exhibit). The applicants propose to build a detached garage. This proposed breezeway roof will be attached to the garage.
No sidewalk or concrete will be poured over the wastewater line within the 20-foot easement. Also, no supporting structures for the roof will be constructed in the easement. Drainage will not be changed. The breezeway will not block or change the water flow in this easement.
Approval of this license agreement is required for the garage to be constructed (See attached Exhibit “B” for aerial map of the property). Lake Ridge Property Owner’s Association has approved the architectural drawings. The detached garage will not be used for living quarters.
All utilities have approved the use of the right of way for parking. The license will have a 10-year term with either party having the right to terminate upon written notice.
Staff recommends approval of the license agreement.
Financial Consideration
Revenue: $500 which is the recommended one-time only charge for the ten-year license in addition to the application fee of $100
