Analysis
FERMIN BALTIERRA PEREZ has requested a license to allow for encroachment on the City’s platted utility easement (See attached Exhibit “B” plat exhibit). Approval of this license agreement is required for 108 Matamoros Street to construct a concrete retaining wall of variable heights in the City’s utility easement and along the perimeter of the yard (See attached Exhibit “A” for aerial map of the property). Any excess dirt from construction of the wall will be used to fill in the backyard.
All public utilities have approved encroachment of the retaining wall on the utility easement. City staff recommends approval of this encroachment and perimeter wall.
The license will have a ten-year term with either party having the right to terminate upon written notice. No liability insurance is required.
Financial Consideration
Revenue: $300.00 which is the recommended one time only charge for the ten-year term license in addition to the application fee of $100.
