Analysis

On September 19, 2016, the Oversight and Safety Division of the Railroad Commission of Texas notified us that we committed a violation at 1021 NE 22nd on September 28, 2010.  The Commission determined that we committed this violation based on records we submitted to them. They allege that we were in violation of of Commission Rule 16 T.A.C. §18.10(b): “The Excavator failed to dig with care within the specified tolerance zone.” The actual violation was failure to report a breech of the gas pipeline within the required 10 days.  While we did self report, it was not within the 10 day window.  We have corrected the procedure.

The original penalty was $1,000.00. They offered to settle the case for $750. The City counter-offered $500, and they accepted our settlement. The penalty was remitted by City Manager authority on October __, 2016.

Financial Consideration

Funding for the administrative penalty amount of $500 is available in the Risk Fund.
