Analysis

Mobilitie is a company that is hired by cell phone companies to help improve their wireless coverage. Mobilitie installs equipment that will amplify existing cell phone coverage. This equipment is placed on a pole in the City's right of way. Traditionally, commercial use of the City's ROW is governed either by a franchise agreement or through access line fees paid to the state and remitted to the City. Because this is a new technology, neither of these types of agreements apply. Many cities have instead opted to create an agreement with Mobilitie where Mobilitie pays an annual fee per pole, based on the type of pole.

Mobilitie sent us a copy of their proposed agreement. We also obtained a copy of the agreement with Dallas. Using both of these contracts as a template, staff has created a contract that has been tailored to the needs of Grand Prairie specifically. Mobilitie has not reviewed our proposed contract yet. Being that this is a totally new way of handing use of the ROW, staff is requesting that the Development Committee and the Finance Committee review this contract prior to review by Mobilitie so that these committees can have some input into the fee schedule and the restrictions that we place on Mobilitie.

Financial Consideration

Mobilitie intends on putting about 15 poles within the City of Grand Prairie. Based on the fee schedule proposed, this would create about $22,500 of annual revenue for the City.
