Analysis
This item has been initiated in response to a proposal by Dung Truong and Matthew Loh to operate a billiard room with ten tables at Asia Times Square, 2625 W Pioneer Parkway (proposal attached). Current regulations allow for billiard rooms or parlors with no more than two tables by right in C, HC, LI, and HI districts.
The change to be discussed is whether to amend Section 4 of the Unified Development Code to:
A. Require any billiard rooms with three or more tables to obtain a Specific Use Permit through a separate line item in the Use Charts, or
B. Amend the Use Charts to include billiard parlors within a category called "Indoor Commercial Amusements", which would allow billiard rooms by SUP in Heavy Commercial and Industrial Districts and Commercial GR, GR-1, C, and C-1 districts.
"Indoor Commercial Amusements" is defined in Article 30 of the Unified Development Code as: "An enclosed facility which provides amusement or entertainment for a fee or admission charge including, but not limited to, indoor amusements such as penny arcades, pool halls, bingo parlors and video arcades." The Code requires clarification as to whether all billiard halls are intended to be allowed in the same zoning district as Indoor Commercial Amusements or limited to facilities with less than three tables.
The Use Charts themselves also require clarification as "Indoor Commercial Amusements" does not specifically appear as a listed use, only "Amusement Services", and because "Billiard Parlor" is only specified as being less than three tables.
STAFF RECOMMENDATION:
Staff recommends approval of Option B, that the use charts be amended to say "Commercial Amusements (Indoor)" rather than "Amusement Services" and that "Billiard Parlor" be explicitly folded into Commercial Amusements.
