Analysis
On August 1, 2017, City Council tabled a Resolution in support of a Texas Parks and Wildlife grant for the proposed park site at the old Great Southwest Golf Course. Texas Parks and Wildlife requires that any new grant lands restrict drilling and mining operations.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, PROHIBITING DRILLING AND MINING OR THE REOPENING OF ANY ABANDONED WELL OR MINE WITHIN THE FORMER SITE OF THE GREAT SOUTHWEST GOLF COURSE LOCATED IN GRAND PRAIRIE, TEXAS; PROVIDING A CUMULATIVE CLAUSE, AND A SAVINGS CLAUSE; AND TO BECOME EFFECTIVE UPON PASSAGE BY THE CITY COUNTIL
WHEREAS, The City of Grand Prairie is submitting a Texas Parks and Wildlife matching grant application for a portion of the old Great Southwest Golf Course site;
WHEREAS, a Texas Park and Wildlife grant application requires that the City restrict drilling and mining activities within the Park site;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1.
1. All forms of drilling and mining are prohibited in the designated park area of the former site of the Great Southwest Golf Course located in Grand Prairie, Texas.
2. No previously drilled and abandoned well or mine may be reopened in the former site of the Great Southwest Golf Course.
3. No use of the surface estate shall be made for the purposes of mining in any form.
SECTION 2. Severability
If any article, section, sub-section, sentence or phrase of this Ordinance should be held to be invalid for any reason whatsoever, such invalidity shall not affect the remaining portions of this Ordinance which shall remain in full force and effect and to this end the provisions of this Ordinance are declared to be severable.
SECTION 3.
All ordinances or parts of ordinances not consistent or conflicting with the provisions of this Ordinance are hereby repealed. Provided that such repeal shall be only to the extent of such inconsistency and in all other respects this Ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered in this Ordinance.
SECTION 4.
This Ordinance shall become effective from and after it passage.
