Analysis

Chapter 791 of the Texas Government Code, also known as the Inter-local Cooperation Contracts Act, authorizes all local governments to contract with each other to perform governmental functions or services including administrative functions normally associated with the operation of government such as purchasing of necessary equipment, supplies and services.

 

The City of Grand Prairie would like to enter into an inter-local cooperative agreement with the NCTCOG so that we may purchase products and services that have been competitively bid by the NCTCOG.  NCTCOG offers contracts for applicant tracking systems, electronic payment services, learning management systems, pavement analysis services, temporary staffing services and other post-employment benefits . Purchasing through cooperative agreements saves Purchasing staff time and gets products and services to departments much sooner.  The City will place orders and make payment directly to the vendor in most instances. 

 

The supplier for each contract shall bill the City directly for all goods and services purchased and the City shall be responsible for payments and ensuring the supplier's compliance with all conditions of the agreement.

 

Financial Consideration

Purchases made through this inter-local agreement will be paid from various Capital or Operating budgets.

A RESOLUTION OF THE CITY OF GRAND PRAIRIE, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A MASTER INTERLOCAL AGREEMENT WITH THE North Central Texas Council of Governments (NCTCOG)

 

Whereas,  the City Council of the City of Grand Prairie, Texas, approves the terms and conditions of the Inter-local Purchasing Agreement between the North Central Texas Council of Governments (NCTCOG). providing for a cooperative purchasing program for goods and services; designating the Purchasing Manager or his designee, as the official representative for the City of Grand Prairie; and

 

Whereas, the City of Grand Prairie, Texas, pursuant to the authority granted under Section 271.101 to 271.102 of the Local Government Code, desires to participate in the described purchasing program, and is of the opinion that participation in this program will be highly beneficial to the taxpayers through anticipated savings to be realized;

 

NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of GRAND PRAIRIE, Texas that:

 

Section 1.  THAT the Cooperative Purchasing Agreement with the North Central Texas Council of Governments (NCTCOG). is found to be acceptable and in the best interest of the City of Grand Prairie and its citizens and is hereby approved.

 

Section 2.  THAT the City Manager is authorized to execute the agreement hereby approved on behalf of the City and that the Purchasing Manager or his designee is hereby designated to act for the City of Grand Prairie in all matters relating to Cooperative Purchasing Agreement including the designation of specific contracts in which the City of Grand Prairie desires to participate.

 

SECTION 3:                     THAT this resolution shall be in full force and effect upon its passage and approval.
