Analysis
On September 19, 2017, City Council authorized agreement between City and NCTCOG for procurement and installation of ITS equipment for data collection along SH 161 Frontage Road traffic signals. Per agreement, City will purchase and install equipment and NCTCOG will then reimburse the City for total cost of procurement and installation.
Based on extensive field observations and site evaluation, taking into consideration the intent of the City’s Incident Management Plan, it is recommended that two of the ITS equipment be installed within NTTA R.O.W.
On July 15, 2014, City Council authorized Original License Agreement with NTTA for installation of three Changeable Message Signs (CMS) within NTTA R.O.W.
Amendment to License Agreement with NTTA is necessary to extend the License to Additional License Area for installation of two ITS equipment on NTTA right of way.
This project will complement City of Grand Prairie existing Traffic Management System by monitoring signal timing performance through data collection and performance measure before and after traffic incidents.
Financial Consideration
There is no cost to the City of Grand Prairie stemming from this agreement.

A RESOLUTION OF THE CITY OF GRAND PRAIRIE, TEXAS, AUTHORIZING THE CITY MANAGER TO AMEND ORIGINAL LICENSE AGREEMENT WITH NTTA FOR INSTALLATION OF ITS EQUIPMENT WITHIN NTTA right of way
Whereas, pursuant to authority granted under the Regional Tollway Authority Act (the "Act") codified as Chapter 366 of the Texas Transportation Code, NTTA owns and operates a turnpike project known as the President George Bush Turnpike Western Extension (the "Project") that comprises limited-access tolled lanes running approximately 11.5 miles generally between extending generally from SH 183 south to IH 20 along the western boundary of Dallas County, Texas; and
Whereas, pursuant to §§366.033 (a) (13) and (14) of the Act, NTTA is authorized to enter into leases, service agreements, licenses and similar agreements with public and private parties governing the parties' use of all or a portion of a turnpike project and do all things necessary to carry out the powers expressly granted; and
Whereas, as part of Original License, as amended and restated hereby, NTTA grants City a nonexclusive license (the “License”) for ingress and egress upon the locations of the Project (the “Original License Areas”) for the purposes of erecting, constructing, maintaining, removing and performing all necessary service work on structures and equipment related to CMS in the Original License Areas under the Original License Agreement; and
Whereas, NTTA agrees to consider written requests from City to extend the License to portions of the Project in addition to the Original License Areas and will be referred to as an “Additional License Area.” Each Original License Area and each Additional License Area (if any) shall be referred to collectively as the “License Areas”;
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of GRAND PRAIRIE, Texas that:
Section 1. The City Manager is authorized to enter into an amendment License agreement with NTTA for the installation of ITS equipment on NTTA right of way.
