Analysis
Since 1962, the company currently doing business as Republic Services of Arlington has provided solid waste collection services for the City of Grand Prairie. Throughout the years, Republic Services has consistently provided efficient waste removal services. The current franchise agreement between Republic Waste Services and the City provides for collection service to be provided in bags at the residential curbside, in bags for qualifying small commercial accounts, in front-load container and/or in roll-off containers. In an attempt to address environmental and other health and safety concerns though the elimination of bagged garbage collection from the high traffic Main Street/Jefferson corridor, the City requested a rate for commercial cart collection to be provided to hand-collect customers. The high concentration of hand-collect commercial customers on Main Street and Jefferson Street made the creation of a commercial cart route for the area feasible.
This change will allow for rolling 96-gallon cart service to be offered to the small commercial businesses on Jefferson and Main Street that are currently collected in bags. There will be a maximum of (2) two 96-gallon carts provided to each business. The rate for one cart will be $5.00 more per month than the commercial bag service currently provided. The rate for a second cart is an additional $10.22 per month.
Financial Consideration
The increase in revenue will be a pass-through to Republic Waste Services and will be and will be revenue neutral. Funding for the commercial hand-collect rate is available in the FY20 approved Solid Waste Operating Fund Budget.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, AMENDING THE SOLID WASTE COLLECTION AND DISPOSAL FRANCHISE AGREEMENT BETWEEN THE CITY OF GRAND PRAIRIE (CITY) AND REPUBLIC SERVICES OF TEXAS LTD. DOING BUSINESS AS REPUBLIC SERVICES OF ARLINGTON (FRANCHISEE) TO ALLOW GARBAGE COLLECTION IN 96-GALLON CARTS TO BE PROVIDED TO COMMERCIAL HAND-COLLECT BUSINESSES IN GRAND PRAIRIE, LOCATED ON JEFFERSON STREET OR ON MAIN STREET, PROVIDING FOR A COMMERCIAL CART SERVICE RATE, AND PROVIDING FOR AN EFFECTIVE DATE OF JANUARY 6, 2020.
WHEREAS, the City has restructured eliminating the position of Environmental Services Director,
WHEREAS, the CITY entered into a ten year franchise agreement with Republic Waste Services of Texas LTD on October 17, 2018;
WHEREAS, the FRANCHISEE submitted a rate quote to provide Solid Waste collection and disposal within the CITY for the commercial hand-collect businesses on Main Street and on Jefferson Street within the City of Grand Prairie;
WHEREAS, the CITY has determined that the proposed rate increase and the service delivery method submitted by the FRANCHISEE is in the best interest of the CITY; and
WHEREAS, it is necessary for the CITY to promote, preserve and protect the public health of its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1. That the term "Environmental Services Director" shall be replaced throughout the franchise agreement with the term "Solid Waste and Recycling Manager".
SECTION 2. That, effective January 6, 2020, Attachment A of the solid waste and disposal franchise agreement entered into between the City of Grand Prairie and Republic Waste Services of Texas LTD on October 17, 2018 and previously amended shall be further amended to read as follows:
"SOLID WASTE AND DISPOSAL FRANCHISE AGREEMENT BY AND BETWEEN THE CITY OF GRAND PRAIRE, TEXAS AND REPUBLIC WASTE SERVICES OF TEXAS, LTD., DBA REPUBLIC SERVICES OF ARLINGTON
