Analysis

In the past ten years, the Airport Advisory Committee has met only three times. Airport matters previously directed to the Airport Advisory Committee are currently directed to committees of the City Council, so the continuation of the Airport Advisory Committee is no longer necessary.  This ordinance dissolves the Committee and deletes the sections of the Code of Ordinances that relate to the Committee's appointment and operation.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, AMENDING CHAPTER 6, “AIRPORTS/AVIATION,” OF THE CODE OF ORDINANCES OF THE CITY OF GRAND PRAIRIE BY REPEALING AND DELETING SECTIONS 6-14, 6-15, AND 6-16; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A CUMULATIVE CLAUSE, A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Section 6-14 provides for the creation of an Airport Advisory Committee to make recommendations to the City Council regarding certain airport related matters; and

WHEREAS, Sections 6-15 and 6-16 provide for the terms of office, membership requirements, and meetings of the Airport Advisory Committee; and

WHEREAS, for a considerable period of time, airport matters that were previously directed to the Airport Advisory Committee have been and are currently directed to the Council Development Committee for consideration; and

WHEREAS, since the Council Development Committee now considers airport matters, an Airport Advisory Committee is no longer necessary and the continued appointment of members to that committee an imprudent use of resources; and

WHEREAS, it is the desire of the City Council to repeal Sections 6-14, 6-15, and 6-16 and dissolve the Airport Advisory Committee

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:

SECTION 1.  That Chapter 6 “Airports/Aviation,” of the Code of Ordinances of the City of Grand Prairie, Texas, is hereby amended by repealing and deleting Section 6-14 “Airport advisory committee-Created,” Section 6-15 “Term of office and membership”, and Section 6-16 “Meetings” and marking such sections as “Reserved.”

SECTION 2.  That Chapter 6, “Airport/Aviation,” of the Code of Ordinances of the City of Grand Prairie, Texas shall remain in full force and effect, save and except as amended by this ordinance.

SECTION 3.   If any article, section, sub-section, sentence or phrase of this Ordinance should be held to be invalid for any reason whatsoever, such invalidity shall not affect the remaining portions of this Ordinance which shall remain in full force and effect and to this end the provisions of this Ordinance are declared to be severable.

SECTION 4.   All ordinances or parts of ordinances not consistent or conflicting with the provisions of this Ordinance are hereby repealed, provided that such repeal shall be only to the extent of such inconsistency and in all other respects this Ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered in this Ordinance.

SECTION 5.   This ordinance shall become effective from and after its passage and approval.

PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS, FEBRUARY 19, 2019.
