SUMMARY:

 

Consider a request for a preliminary plat creating 3 lots consisting of 8.016 acres.  The subject site is generally located east of S.H. 360 and north of W. Camp Wisdom Rd.  The property is zoned Planned Development 114A (PD-114A) and is within the S.H. 360 Corridor Overlay District.

 

COMMENTS:

 

This property is being platted in conformance with the requirement for new construction.  The owners are proposing the development of a restaurant, self-service storage, and an undetermined use pad site (Lot 1) for this property.

 

The Engineer has completed the technical revisions as requested by staff.  Other than minor technical revisions and final submittal requirements prior to filing, this plat is recommended for conditional approval by the Commission.

 

Conditional approval of this plat by the Planning & Zoning Commission shall constitute approval subject to conformity with the prescribed conditions, but shall constitute disapproval until such conditions are met.

 

With the exception of the items listed as conditions of approval, this plat is in substantial compliance with the requirements of the Unified Development Code.

 

RECOMMENDATION

 

The Development Review Committee recommends approval of the Equestrian Crossing Lots 1-3, Block 3 Preliminary Plat in conformance with the following conditions and informational comments.

M.                     1.                      Add the case number P140702 to the lower right corner of all new submittals.

I.                     2.                      This is a request for approval of a Preliminary Plat creating 3 lots on 8.016 acres.

M.                     3.                     The preliminary and final plats must conform to the provisions of the previously approved Specific Use Permits and Site Plans (SU140501 S140504 Golden Chick) (SU140502 S140506 Self Storage).

M.                      4.                     Add the zoning classification and front building setback line to each lot not currently shown on the Final Plat submittal.

M.                     5.                      Add the following zoning and setback disclaimers on the Final Plat submittal. 1) Existing or future minimum set-backs established by City Ordinance shall take precedence over building lines indicated on this plat. 2) Zoning classifications indicated on this plat reflect the zoning in place at the time this plat was approved and does not represent a vested right to the zoning indicated.

M.                     6.                      Add the standard plat wording “dedication statement”, metes and bounds description, Surveyor’s Statement, and Notary Statement to the Final Plat.  No signatures are required on the Preliminary Plat.

I.                     7.                                          Sidewalks are required along all streets per Article 12 of the Unified Development Code (UDC).  Is there a reason that no sidewalks are shown in front of Lot 1?

I.                     8.                     Street trees are required along all arterials and collectors per Article 8 of the Unified Development Code.

I.                     9.                     All utility lines within the platted area will be required to be installed underground.

M.                     10.                      Will there be a multi-tenant sign located along the SH 360 Frontage Road?  If yes, you’ll need to show the location of the proposed sign easement 

I.                     11.                     Staff has identified the items necessary to continue the submittal review process. Please make revisions, and corrections, and provide additional information as requested. The applicant may contact Jim Hinderaker at 972-237-8261 to schedule a meeting to discuss disputed issues or the review process.  If revision issues are resolved, bring 3 copies of the revised plans to be reviewed at the Development Review Committee meeting on June 26, 2014.  (Attendance is mandatory).  If revisions are approved, we will provide final submittal requirements and schedule the case for the next available P & Z Meeting.

M.                     1.                     The following note must be added to the final plat covering the detention basin:

                                          The City of Grand Prairie is not responsible for the design, construction, operation, maintenance, or use of any detention pond or underground detention facility and associated drainage easements, hereinafter referred to as “improvement,” to be developed, constructed or used by Owner or his successors, assigns or heirs.  Owner shall indemnify, defend and hold harmless the City of Grand Prairie, its officers, employees, and agents from any direct or indirect loss, damage, liability, or expense and attorneys’ fees for any negligence whatsoever, arising out of the design, construction, operation, maintenance, condition, or use of the “improvement,” including any non-performance of the foregoing.  Owner shall require any successor, assigns or heirs in interest to accept full responsibility and liability for the “improvement.”  All of the above shall be covenants running with the land.  It is expressly contemplated that the Owner shall impose these covenants upon all the lots of this plat abutting, adjacent, or served by the “improvement.” It is also expressly contemplated that the Owner shall impose these covenants upon any successor, assigns or heirs in interest the full obligation and responsibility of maintaining and operating said “improvement.”  Owner shall require any successor, assigns or heirs in interest to accept full responsibility and liability for the “improvement.”  All of the above shall be covenants running with the land.

 

M.                     2.                     Detention facilities are proposed for this site. Before any final plat or building permit can be approved the property owner must dedicate the necessary detention and drainage easements and accept the City New Development General Guidelines for the Operation and Maintenance of Stormwater Management Facilities and sign the city standard Owner/Developer Inspection and Maintenance Agreement form covering the proposed Stormwater management facilities which form shall be filed with the county against the property. For more information please refer to City Ordinance 9039-2010.

M.                     3.                     City approved grading, drainage, and erosion control plans are required prior to approval of any final plat, earthwork or building permit for the property. Such plans shall include complete plans and profiles of all storm drainage facilities with hydrologic and hydraulic information designed to current standards as provided in the Drainage Design Manual as currently amended. Tie storm drain hydraulics to existing downstream storm drain and extend to upstream properties. Where applicable, drainage from site shall discharge into drainage easement and shall convey flow to stream without causing erosion or flooding (maximum downstream velocity 6 fps). 100-year overflow shall be conveyed to stream in drainage easement;

M.                     1.                     ON-SITE SEWAGE FACILITIES: 

 

                                          Per TCEQ rules §285.36, owners of any property where an abandoned septic tank is located must have the wastewater/septage removed by a licensed liquid waste transporter, holding a valid registration with both the TCEQ and City, and back fill the tanks(s) with sand or other suitable fill material (less than three inches in diameter).

 

M.                     2.                     WATER WELLS:  Please note any abandoned or currently used water wells on the preliminary and final plat.  According to the City of Grand Prairie ordinance and the Texas Water Code Chapter 32 § 32.017, Plugging of Water Wells, owners of any property where an abandoned well is located must have the well plugged by a licensed well driller, holding a valid registration with the TCEQ.  A permit will be required to abandon the well.  In addition a copy of the well completion report must be supplied to the Environmental Services Department before any building permit will be issued. 

M.        4.                     SOIL TESTING:   For development of a tract of land that is greater than one acre in area, the applicant must provide documents demonstrating compliance with Title 30, Part 1, Chapter 330, Subchapter T of the Texas Administrative Code relating to the use of land over closed municipal solid waste landfills.
