Analysis

On October 2nd, 2007, the City Council approved ordinance 7951 establishing a geotechnical and material testing services fee. This ordinance required the developer to pay the city of Grand Prairie for the consultant costs to perform this service as escrow funding deposited in the street plan review (403199) to perform this work. Due to increases in costs a new geotechnical and material testing services fee has been negotiated.

 

To avoid any conflict of interest, Staff is recommending that this service be provided by a geotechnical/material testing services firm that is hired by and reports to the City.

 

Please note that this is a pass through fee for private development projects, with the City administering the process.  On City capital improvement projects, the City will incur this cost as part of the project.

 

Financial Consideration

The developer is to pay the City of Grand Prairie based on the established  geotechnical and material testing fee as escrow funding to be deposited directly to the street plan review (403199) 21691 (Escrow Geo-Tech) to perform this work. The City then pays the City contracted  consultants directly from the developer's escrow funds for the work performed.  Since this is a pass though cost, funds not used shall be reimbursed to the developer; however, the developer shall compensate the City for any additional costs incurred.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, REPLACING ORDINANCE 7951 IN ITS ENTIRETY, DETERMINING THE NECESSITY FOR A GEOTECHNICAL AND MATERIAL TESTING SERVICES FEE

 

WHEREAS,  the City Council has determined that it is important that City and private development projects be designed based on field geotechnical information where needed and materials tested according to the plans and specifications;

 

WHEREAS,  it is important that proper geotechnical and material testing services work be performed to meet standards and specifications;

 

WHEREAS,  this Ordinance will supersede and replace Ordinance 7951 in its entirety.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:

 

SECTION 1.  That it is hereby determined to be in the best interests of the City of Grand Prairie, Texas and its inhabitants to adopt the following geotechnical and material testing fees.

The following general requirements shall apply:

 

a. Developer or designee shall coordinate this work with the approved City firms providing this service with proper advance notifications of a minimum of two week

b. Developer or designee to provide copies of any and all associated on-site preliminary plans to determine the work scope.

c. Current design requirements shall apply.

d. Any and all review comments shall be addressed with subsequent submittals.

e. Overtime work is defined as any extra time spent over 8 hours Monday through Friday and work performed on Saturdays, Sundays or holidays. The overtime hourly charge rate is 1.33 times the listed regular hourly rate.

f. Since this is a pass through cost, funds not used shall be reimbursed to the developer.

g. Developer shall compensate the City for any additional costs incurred.

h. City Staff will help resolve issues.
