Analysis
In an offer letters (see attached offer letters) dated February 12, 2016, the Texas Department of Transportation (TxDOT) has offered to buy 0.0291 of one acre as fee title, 0.0918 acre and 0.2197 acre as drainage easements from the south side of IH 20 along their project limits from SH 161 east to Carrier Parkway, Grand Prairie, Dallas County, Texas. These right of way parcels are required for the construction of frontage roads.
In order to accept this offer, the City must pass a resolution agreeing to the sale. The offer amount was prepared by a State certified appraiser which represents fair, reasonable and market value for the City’s interests. Any City ownership of oil, gas, and sulphur is not included in the sale. This property is required for the construction of frontage roads by TxDOT.
Passage of this resolution is required by TxDOT and their title company to give the City Manager, or his delegate, authority to the sign all required documents to complete the sale. It will provide TxDOT the required authorization to proceed with this purchase from the City. Conveyance of these properties will be by a Special Warranty Deed (designated as Parcel No. 11) for the fee parcel and Drainage Easement for Highway Purposes (designated as Parcels No. 8E and 9E).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS, AUTHORIZING THE SALE OF 0.0291 ACRE OF LAND AS FEE TITLE, 0.0918 ACRE AND 0.2197 ACRE OF LAND AS DRAINAGE EASEMENTS TO THE TEXAS DEPARTMENT OF TRANSPORTATION FROM THE SOUTH SIDE OF IH 20, WITHIN THEIR RIGHT OF WAY PROJECT LIMITS FROM SH 161 EAST TO CARRIER PARKWAY; AUTHORIZING THE CITY MANAGER OR HIS DELEGATE TO ENTER INTO AND SIGN ANY REQUIRED DOCUMENTS TO COMPLETE THE SALE; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, offers by the Texas Department of Transportation (TxDOT) have been made to purchase the 0.0291 of one acre as fee title , 0.0918 acre and 0.2197 acre as drainage easements from the south side of IH 20 along their project limits from SH 161 east to Carrier Parkway, Grand Prairie, Dallas County, Texas, required for the construction of frontage roads; and
WHEREAS, offers have been made to buy this land and easements for the total appraised amount of $14,600; and
WHEREAS, this purchase amount is fair, reasonable and represents fair market value of these properties and interests being acquired (see attached Exhibit “A” for property descriptions); and
WHEREAS, the City Council of the City of Grand Prairie desires to sale and authorize the sale of these properties;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1: That the City of Grand Prairie hereby concurs in the and authorizes the sale of 0.0291 of one acre as fee title , 0.0918 acre and 0.2197 acre as drainage easements from the south side of IH 20 along the TxDOT project limits from SH 161 east to Carrier Parkway Grand Prairie, Dallas County, Texas, to the Texas Department of Transportation (TxDOT).
SECTION 2: That the City of Grand Prairie does hereby consent to the sale of said properties.
SECTION 3: That the City Manager or his delegate is hereby authorized to sign any and all required documents related to the sale as required to complete the sale to TxDOT.
SECTION 4: That this resolution shall become effective immediately upon its passage and approval.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS, ON THIS THE 1ST DAY OF MARCH, 2016.
