This is the last of a series of boundary adjustments between the cities of Grand Prairie and Irving and Dallas County that were to take place following the realignment and construction of Hunter Ferrell Road and MacArthur Boulevard and construction of bridges on these respective roadways. This boundary adjustment would transfer the last segment of the MacArthur bridge from Grand Prairie to Irving, whereupon the bridge would sit entirely within the City of Irving and maintenance of the bridge would become Irving's responsibility. Adoption of the ordinance will approve the boundary adjustment agreement.
A Memorandum of Understanding (Exhibit i) was approved and signed by the cities of Grand Prairie and Irving indentifying certain parcels along Hunter Ferrell and MacArthur for boundary adjustments. The parcel under consideration "parcel 7" is a 0.5969 acre tract and the south end of the MacArthur bridge, and is the last of the parcels intended within the MOU for boundary adjustment. All other boundary adjustments were completed in 2015.

AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITIES OF IRVING AND GRAND PRAIRIE ADJUSTING THEIR COMMON BOUNDARY LINE AND JURISDICTIONS ALONG A CERTAIN PORTION OF MACARTHUR BOULEVARD; PROVIDING THIS ORDINANCE BE CUMULATIVE; AND PROVIDING FOR SEVERABILITY, GOVERNMENTAL IMMUNITY, AND AN EFFECTIVE DATE
WHEREAS, the development and widening of MacArthur Boulevard resulted in a certain portion of a newly-constructed bridge facility being located within the municipal jurisdiction of Grand Prairie; and
WHEREAS, pursuant to Sections 43.003 and 43.015 of the Texas Local Government Code, the City of Grand Prairie and the City of Irving wish to enter into an agreement adjusting the common boundary line between the cities so that the portion of the bridge located in Grand Prairie be located within the city limits of Irving; and
WHEREAS, Irving will be responsible for the maintenance of the bridge facility and the cities desire it to be wholly inside the city limits of Irving, rather than extending partially into Grand Prairie; and
WHEREAS, the City Council finds that it is in the public interest for the City of Grand Prairie to make such an adjustment;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1
That the City Council does hereby approve the Boundary Adjustment Agreement attached hereto as Exhibit “A”, and the City Manager is hereby authorized to execute the agreement.
SECTION 2
That the official map of the City of Grand Prairie, Texas, shall be amended to reflect the adjustment to the common boundary line between the two cities.
SECTION 3
That upon final passage of this ordinance, the City Secretary shall transmit a certified copy of this ordinance to the City Secretary of the City of Irving.
SECTION 4
This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Grand Prairie; and this ordinance shall not operate to repeal or affect any of such other ordinances except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any, in such other ordinance or ordinances are hereby repealed.
SECTION 5
If any article, section, sub-section, sentence or phrase of this Ordinance should be held to be invalid for any reason whatsoever, such invalidity shall not affect the remaining portions of this Ordinance which shall remain in full force and effect and to this end the provisions of this Ordinance are declared to be severable.
SECTION 6
That all of the regulations provided in this ordinance are hereby declared to be governmental and for the health, safety and welfare of the general public. Any member of the City Council or any City official or employee charged with the enforcement of this ordinance, acting for the City of Grand Prairie in the discharge of his/her duties, shall not thereby render himself/herself personally liable; and he/she is hereby relieved from all personal liability for any damage that might accrue to persons or property as a result of any act required or permitted in the discharge of his/her said duties.
SECTION 7
That this ordinance shall take effect upon approval and adoption of the attached agreement by the City of Irving or immediately from and after its passage in accordance with the provisions of the Charter of the City of Grand Prairie, whichever occurs later.
