Analysis
The treated water contract with the City of Fort Worth requires that any water restrictions imposed by Fort Worth must be likewise imposed by the customer cities on their retail customers. Fort Worth has moved 2 day per week irrigation restrictions and the prohibition on irrigating between the hours of 10 AM and 6 PM from their Emergency Water Use (aka Drought Contingency) Plan to their Water Conservation Plan, which means that these requirements are applicable year-round and not only in times of a declared water emergency due to drought or other factors. However, the Emergency Water Use Plan remains and imposes further restrictions in the event of a water emergency.
Fort Worth took the above actions since we passed our water conservation plan in 2009 which brought us into compliance with their requirements at that time. While we have generally been following these requirements anyway, we need to make these same adjustments to our water conservation plan. Like Fort Worth, we will maintain an Emergency Water Use Plan that imposes more stringent restrictions during water emergencies.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, AMENDING THE CODE OF ORDINANCES, SECTION 26-158, AND AMENDING THE WATER CONSERVATION ORDINANCE 7937 TO PROHIBIT IRRIGATION BETWEEN THE HOURS OF 10:00 A.M. AND 6:00 P.M. YEAR ROUND AND LIMITING IRRIGATION TO TWO DAYS PER WEEK
WHEREAS, the treated water contract with the City of Fort Worth requires that water restrictions imposed by Fort Worth shall likewise be imposed by its' customer cities and
WHEREAS, Grand Prairie has a treated water contract with the City of Fort Worth by virtue of which some 2.5 million gallons per day is supplied to Grand Prairie and
WHEREAS, Grand Prairie wishes to fulfill its' contractual obligations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1. That Section 26-158 (a) of the City of Grand Prairie Code of Ordinances be amended to read:
Except for hand watering and the use of soaker hoses, a person commits an offense if that person irrigates, waters, or causes or permits the irrigation or watering of any lawn or landscape located on premises owned, leased, or managed by that person between the hours of 10:00 a.m. and 6:00 p.m.
SECTION 2. That Section 26-158 (f) shall be added to read:
All Grand Prairie water customers shall water no more than two days per week according to the following rules unless the customer receives an approved variance:
Even Numbered addresses watering on Mondays and Thursdays.
Odd numbered addresses water on Tuesday and Fridays.
City government will schedule landscape watering so that a particular facility location will be watered no more than two days per week.
Irrigated areas not having a numbered address shall be assigned an address by the City
SECTION 3. That Section 26-158 (d) shall have the following affirmative defense added:
(D) The customer has received an approved variance from the City stating the applicable conditions and beginning and ending periods of the variance.
