Analysis
Prairie Waters Development is the retail/commercial development at the southeast corner of S.H. 360 and Ragland Road in Grand Prairie. This site is one of the last intersections in Grand Prairie along State Highway 360 with attractive access and visibility. In an effort to attract retail/commercial developments at this intersection, developer Charlie Anderson of CWA Management, LLC, has proposed constructing the necessary infrastructure to prepare the area for development and to serve other adjacent properties and provide oversizing for service to additional properties. Mr. Anderson’s Prairie Waters Development will have approximately 34 acres of retail/commercial acres in the Development.
The City Council has previously discussed this agreement. This was presented to the CCDC in December. It was scheduled to be presented to the December F&G committee but due to the long December agenda and previous discussion with the City Council was removed from their agenda.
This infrastructure is part of the 2014 Freese and Nichols CIP study (map attached) to get the area "Development Ready." That plan was funded in the City's CIP. This agreement is proposed for construction with the City and the Prairie Waters Development including water, sewer, paving and drainage that will allow this area to be "Development Ready." There are two agreements discussed with the City Council regarding the infrastructure for this area. The City Council approved a resolution for Chapter 380 Agreement previously approved by the City Council on November 1, 2016 (16-6159). This agreement covers the City CIP portion that the Developer is constructing instead of the City constructing to take advantage of the other work done by the Developer. This is being done at a substantial savings to the City' CIP for this infrastructure.
Total project cost will be $1,896,165. Any change orders and additional costs over this amount have to be approved by both parties. All public participation in the cost of the Public Improvements associated with the project is dedicated to the extension of the improvements as per the Capital Improvements Plan, to increase necessary capacity for existing and in anticipation of other future development in the area as approved in the City's Capital Improvement Projects budget. Further, the City’s participation shall be based on funds appropriated for this project in the Capital Projects Funds. The City’s participation amount will remain applicable for a period not to exceed 24 months. If work on the Public Improvements has not been initiated within 24 months of the date this Agreement was executed and the Agreement has not been amended by the City Council to provide for an extension, then this Agreement shall be terminated and the City will have no further obligation under this Agreement.
Financial Consideration
City Participation in the total amount of $1,896,166 will be available as follows:
1. $349,705 is available in Wastewater Capital Project Fund (500692) WO #01410301 (Day Miar/Ragland WWST)
2. $298,739 is available by appropriating and transferring from the unobligated fund balance in the Water Capital Projects Fund (500592) to Wastewater Capital Projects Fund (500692) WO #01410301 (Day Miar/Ragland WWST)
3. $214,719 is available in Water Capital Project Fund (500592) WO #01311901-03 (Day Miar/Ragland WTER)
4. $1,033,003 is available in Street Capital Project Fund (400192) WO #01506801-03 (Seeton Grand Peninsula/Day Miar)

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, AMENDING THE FY 2016/2017 CAPITAL IMPROVEMENT PROJECTS BUDGET BY TRANSFERRING AND APPROPRIATING $298,739 FROM THE UNOBLIGATED FUND BALANCE IN THE WATER CAPITAL PROJECTS FUND (500592) TO WASTEWATER CAPITAL PROJECTS FUND (500692) WO #01410301 (DAY MIAR/RAGLAND WWST)
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1. THAT THE FY 2016/2017 Capital Improvement Projects Budget be amended by transferring and appropriating $298,739 from the unobligated fund balance in the Water Capital Projects Fund (500592) to Wastewater Capital Projects Fund (500692) WO #01410301 (Day Miar/Ragland WWST)
