Analysis
Under the Fire Code, the Fire Department is responsible for assuring all commercial alarms to include Fire, Sprinkler, Hoods, Smoke, etc are tested and certified on an annual basis. Using existing personnel makes this responsibility very difficult so the Fire Department is wanting to utilize a third party service to manage this process. This was presented to the CCDC on August 20, 2018 and passed unanimously.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS, AMENDING THE CODE OF ORDINANCES, CHAPTER 12, "FIRE PROTECTION AND EMERGENCY MANAGEMENT", ARTICLE I, SECTION 12-10 FROM "RESERVED" TO "THIRD PARTY INSPECTIONS, INTERNATIONAL FIRE CODE SECTION 107.3, RECORDKEEPING" TO BECOME EFFECTIVE UPON ITS PASSAGE AND APPROVAL
WHEREAS, the Grand Prairie Fire Department is responsible for assuring that all commercial permitted fire safety systems are tested annually and in good working order as defined in the International Fire Code.
WHEREAS, requiring contractors to use a fire code official approved process will enable the Grand Prairie Fire Department to track each inspections, drive code compliance, reduce false alarms, and protect the safety of the citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1. Article I, Section 12-10 is amended to read in its entirely as follows:
Section 12-10.- Third Party Inspections, International Firecode Section 107.3, Recordkeeping.
(a) Section 107.3 of the International Fire Code is revised to read as follows: "107.3 Recordkeeping. A record of periodic inspections, tests, servicing and other operations and maintenance shall be maintained on the premises or other approved location for not less than 3 years, or a different period where specified in this code or referenced standards. Records shall be made available for inspection by the Fire Code Official and a copy of the records shall be provided to the fire code official upon request."
(b) The Fire Code Official is authorized to prescribe the form and format of such recordkeeping. The Fire Code Official is authorized to require that certain required records be filed with the Fire Code Official.
(c) The Fire Code Official may utilize a third-party inspection reporting system for the prescribed recordkeeping. The administrative fee for submittals to third party inspection reporting system may not exceed $15 per system, per annum.
SECTION 2. Savings Clause.
That Chapter 12 of the Code of Ordinances of the City of Grand Prairie, Texas shall remain in full force and effect, save and except as amended by this ordinance.
SECTION 3. Severability Clause.
If any article, section, sub-section, sentence or phrase of this Ordinance should be held to be invalid for any reason whatsoever, such invalidity shall not affect the remaining portions of this Ordinance which shall remain in full force and effect and to this end the provisions of this Ordinance are declared to be severable.
SECTION 4. Cumulative Clause.
All ordinances or parts of ordinances not consistent or conflicting with the provisions of this Ordinance are hereby repealed. Provided that such repeal shall be only to the extent of such inconsistency and in all other respects this Ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered in this Ordinance.
SECTION 5. Effective Date.
This ordinance shall become effective from and after its passage as provided by law.
