Analysis
A 6.94 acre portion of property owned by Irving generally located at the intersection of east ROW line of Belt Line Road and the southeast ROW line of State Highway 161, Irving, Texas is the site for a proposed joint fire training facility between the City of Grand Prairie and City of Irving, TX. The initial term of the agreement shall commence on the effective date and end at 11:59"59 p.m. Central Time on the last day of the Fiscal Year following the twentieth (20th) anniversary of the Acceptance Date. The title of the fire training facility shall be 50% undivided interest for each City with the division of shared capital costs at 50% undivided interest each City.
Prior to the City of Irving becoming contractually obligated to pay a shared capital cost, the City of Grand Prairie will pay their respective share of the shared capital cost to the City of Irving. The City of Irving agrees to place such funds into a restricted project account and that such funds shall only be used for the restricted purpose.
Per the MOU, a governing board shall be established for the purpose of administering and operating the facility that will be comprised of 50% representatives from each fire department. The annual facility budget shall clearly indicate the amounts, sources and purposes of revenues to be contributed by each City as its share of the annual facility budget.
This agreement states the purpose, terms, rights, and duties of the parties in relation to the design, construction and use of the joint training facility. Per the MOU, there are legal clauses protecting each City from default or early termination of the agreement.
Financial Consideration
The final cost to the facility will be completed once the design is at 100% and all cost estimates are submitted. The City of Grand Prairie is only paying for the portion of the facility that it will use and manage. The original presentation to the City Council was estimated at $1.75 million for the City of Grand Prairie and currently a $2 million request has been submitted as part of the FY 2015/2016 Capital Improvement Projects Plan.
