Analysis
A recent consultant review of various City owned facilities identified the Municipal Courts service counter as an area of concern that should have various security upgrades incorporated. More specifically, it was noted that the security separation between the customer service staff and the public should be enhanced, especially in light of the fact that a significant amount of money is handled at this location on a day to day basis. Komatsu Architecture, who was working on similar security upgrades at City Hall and was familiar with the primary objectives, was contracted under CMO approval authority to proceed with professional design services.
In this case, it was deemed an appropriate time not only to enhance the security separation, but also to expand the service counter area with three more stations for improved customer service capabilities. The plans were subsequently prepared by the Architect and competitive bids were advertised and solicited in accordance with State law. While several prospective bidders attended the pre-bid conference, only one bid was received by the 8/19 bid deadline, that of Mart, Inc., with a base bid in the amount of $207,700. Also received was Additive Alternate Bid No 1 in the amount of $20,000 for upgrading the bullet resistant glazing and the under counter reinforcement hardening from a level 3 to level 6 security rating.
The base bid was higher than the pre-bid estimate that had been generated by the Architect, but after consideration by City staff, it was determined to proceed with a recommendation for award by Council, inclusive of the base bid and the additive alternate. It was reasoned by staff that Mart had no knowledge of the fact that there would be no other bids received, so their bid was prepared and submitted in what was assumed would be a competitive bid climate based on the pre-bid conference attendance by several bidders. Additionally, with the bidding market now quite active, there was no guarantee that a rebid of the project would result in lower bids. Mart, Inc. has been a very active participant in competitively bidding City projects and has been awarded several construction projects by the City on which they have successfully performed. On that basis, City staff is recommending award of this project to Mart, Inc. by Council.

Funding for a construction contract to Mart, Inc. in the amount of $227,700 for Security Upgrades at the City’s Municipal Courts facility, plus a 5% construction contingency in the amount of $11,385 for a total request of $239,085 is available in the FY 2014/2015 Risk Management Fund (212010) Construction (68540).
