Analysis
State purchasing laws, Government Code, Chapter 271 authorize local governments to enter into joint contracts and cooperative agreements (such as TIPS accessing their service providers) for the performance of governmental functions normally associated with the operation of government such as purchasing necessary materials and supplies. The City has a master interlocal agreement with TIPS allowing us to use their price agreement contracts. TIPS has a general carpentry services price agreement with Payless Home Repairs. The City has no contract with Payless Home Repairs but during the past 12 month period several city departments have issued a number of purchase orders (individually as large as $13,000 and totally approximately $47,000) to them for carpentry services. In addition, staff also has general projects planned for the next few months scheduled to be done by Payless Home Repairs, including reconstruction at City Hall (after the asbestos abatement work) that will exceed $50,000. Staff recommends entering into a contract with Payless Home Repairs that would ratify the prior purchase orders and authorize the reconstruction after asbestos abatement work at City Hall and the various general projects. Thus, City Council's approval is requested for not only ratifying the purchase order expenditures but also additional funding for the reconstruction work and general projects up to $100,000 through April, 2015.
Payless Home Repairs' contract with TIPS expires April 23, 2015. If Payless Home Repairs wins a new price agreement with TIPS, city staff will return to City Council to request award of a new annual contract.
Financial Consideration
Funds are available in various departments' operating budgets and will be charged accordingly on orders through the end of the fiscal year.
