Analysis
SUMMARY:
 
Consideration of a request for the approval of a Replat of 0.5740 acres subdividing one non-residential lot into two non-residential lots. The subject property is zoned Commercial (C) District, and is located on the north side of E. Main Street west of N. Bagdad Road. The subject property is located within the Central Business District-Three (CBD-3) Overlay District.
 
ISSUES
 
This replat is being submitted to subdivide one lot into two lots. The property is deeper than it is wide. It is being divided in a manner that the lot at the rear will not have direct access to a public right-of-way. Staff has required a cross access easement on Lot 1R-1 with frontage to allow Lot 1R-2 access to E. Main Street.
 
This condition will require an exception to the frontage requirements as required by Section 12.17.3 of the Unified Development Code, which requires that each lot shall face on a public street.
 
Platting exceptions must be approved by City Council per Section 12.14.1 of the Unified Development Code.
 
The Engineer has completed the technical revisions as requested by staff. Other than minor technical revisions and final submittal requirements prior to filing, this plat is recommended for conditional approval by the Commission.
 
Conditional approval of this plat by the Planning & Zoning Commission shall constitute approval subject to conformity with the prescribed conditions, but shall constitute disapproval until such conditions are met.
 
With the exception of the items listed as conditions of approval, this plat is in substantial compliance with the technical requirements of the Unified Development Code.
 
RECOMMENDATION
 
The Development Review Committee recommends approval of the Final Plat of Lots 1R-1 and 1R-2, Jackson Womack Davis Subdivision in conformance with the following conditions and informational comments.
 
CURRENT PLANNING
 
1. Add the case number (RP101101) to the lower right corner of all new submittals [Article 12].
2. Sidewalks are required along all streets [Article 12.26].
3. Seals and signatures of the surveyor or engineer preparing the plat are required prior to final submittal. [Article 12.9.2.I].
4. Show a 15 foot utility easement adjacent to public right of way.
5. Since this plat does not front on a public street and uses a mutual access easement, it must be approved by the Planning & Zoning Commission. [Article 12.5.1.B]
6. All utilities, within the platted area, shall be placed below ground, except
for major high voltage transmission lines. Major utility structures, which must be located above ground, shall be placed in unobtrusive locations, and shall be screened with landscaping that blends into the overall landscaping area [Article 8.8.7.1].
7. Lot at the rear does not have access to a public right-of-way. A cross access easement must be provided and shown on the lot to the south on this plat or a cross access agreement filed by separate instrument on an adjacent property with recording information shown on this plat document prior to filing of the plat at the county.
8. Indicate the area of each lot in square feet and acres on the lot.
9. Show the right-of-way along E. Main Street.
10. Provide a numeric scale under the graphic scale. i.e. Scale: 1-40.
11. Provide a digital (.dwg) of this plat at the DRC meeting October 21, 2010.
Only the property line work and street center lines will be required.
12. Engineering plans must be approved prior to filing the plat.
13. The current years taxes must be paid prior to filing the plat.
14. The applicant will be asked to file the plat with the county after the City Chief Planner
15. Approval of a final plat or re-plat shall expire one (1) year from the date of the Planning and Zoning Commission action if the conditions of approval have not been satisfied.
16. The address for this plat will be as follows:
Lot 1R1 - 2230 E. Main St.
Lot 1R2 - 2232 E. Main St.
17. Early warning siren fees are prescribed by Article 22 of the Unified Development Code.
Section 22.5.3.
2a. Development for which a final or replat is required to be submitted to the City for approval in accordance with state law and the ordinances of the City, or (6/7/2005). An invoice for $ 7.16 will be sent with the approval letter. Payment can be made when submitting final mylars to the city for approval.
18. Dallas County plats are required to have a 1 inch (1) margin at the top of the plat.
 
ENGINEERING/FLOODPLAIN
 
1. Need City approved grading and drainage plans prior to starting any earth disturbing activities and approval of any building permit associated with such activity.
TRANSPORTATION SERVICES
 
1. Provide a 24 access easement from Main to the back property.
