SUMMARY:

 

AMENDING MASTER TRANSPORTATION PLAN AND THE THOROUGHFARE MAP TO DELETE THE EAST-WEST COLLECTOR ROADWAY BETWEEN S. GREAT SOUTHWEST PARKWAY AND FALL DRIVE.

 

BACKGROUND:

 

The proposed expansion of the ‘Fresh Express’ industrial development immediately south of subject collector prompted this request.  Fresh Express is located north of W. Warrior Trail and sits approximately 645 feet east of S. Great Southwest Parkway (2370 W. Warrior Trail).  The City was approached by the developer/owner to delete this section of an east-west collector and has provided a Traffic Study to support no adverse impact to surrounding traffic patterns based on existing and future land uses and conditions

 

RECOMMENDATION:

 

The DRC supports the removal/elimination of an east-west collector street from S. Great Southwest Parkway extending east to Fall Drive from the Master Thoroughfare Plan., based on the applicant finding and staff’s review of a commissioned engineering traffic study of the immediate area.

AN ORDINANCE OF THE CITY OF GRAND PRAIRIE, TEXAS AMENDING ARTICLE 23: “MASTER TRANSPORTATION PLAN” OF THE UNIFIED DEVELOPMENT CODE ESTABLISHED BY ORDINANCE NUMBER 4779 AND PASSED ON NOVEMBER 20, 1990; TO ELIMINATE THE RECOMMENDED EXTENSION OF  A SEGMENT OF AN EAST-WEST COLLECTOR ROADWAY FROM ITS PROPOSED TERMINUS LOCATED BETWEEN S. GREAT SOUTHWEST PARKWAY CONNECTING TO FALL DRIVE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND TO BECOME EFFECTIVE UPON ITS PASSAGE AND APPROVAL.

 

WHEREAS, Section 1.11.3.1 of the Unified Development Code of the City of Grand Prairie, Texas states: “Amendments to the text of the Unified Development Code shall be initiated only by action of the City Council directing the City Manager to initiate such a request on be-half of the City or by the City Manager's own initiative.;” and

 

WHEREAS, the City Manager’s office authorized the Planning and Development Department of the City of Grand Prairie, Texas to initiate an amendment of Article 23, “Master Transportation Plan”, of the Unified Development Code to eliminate the recommended extension of An East-West Collector segment roadway between S. Great Southwest Parkway to Fall Drive

 

WHEREAS, this Master Transportation Plan amendment request was originally part of a Zone Change/Site Plan request as provided via Planning Case No. Z171003/S171003 and subsequently assigned Planning Case No. MTP171001 to ensure that said action is correctly documented and filed; and

 

WHEREAS, the Planning and Zoning Commission of Grand Prairie, Texas, held a public hearing on said application on October 2, 2017, after written notice of such public hearing before the Planning and Zoning Commission on the proposed Master Transportation Plan amendment had been sent to owners of real property lying within 300 feet of the property on which the elimination of the planned east-west collector roadway from S. Great Southwest Parkway to Fall Drive is proposed, said Notice having been given not less than ten (10) days before the date set for hearing to all such owners who rendered their said property for City taxes as the ownership appears on the last approved City Tax Roll, and such Notice being served by depositing the same, properly addressed and postage paid, in the City Post Office; and

 

WHEREAS, after consideration of said application, the Planning and Zoning Commission of the City of Grand Prairie, Texas voted 8 to 0 to recommend to the City Council of Grand Prairie, Texas, that said amendment should be approved since its provisions are in the public interest and will promote the health, safety and welfare of the community; and

 

WHEREAS, Notice was given of a further public hearing to be held by the City Council of the City of Grand Prairie, Texas, in the City Hall Plaza Building at 6:30 o'clock P.M. on October 17, 2017 to consider the advisability of amending Article 23, “Master Transportation Plan”, of the Unified Development Code as recommended by the Planning and Zoning Commission, and all citizens and parties at interest were notified that they would have an opportunity to be heard, such Notice of the time and place of such hearing having been given at least fifteen (15) days prior to such hearing by publication in the, Fort Worth Star Telegram , Fort Worth, Texas, a newspaper of general circulation in such municipality; and,

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:

 

SECTION 1.

 

THAT Article 23, “Master Transportation Plan,” of the Unified Development Code be amended to eliminate the recommended extension of an east-west collector roadway from S. Great Southwest parkway to Fall Drive, as shown on Exhibit A - Location Map, Exhibit B - MTP Amendment Map 1, and Exhibit C - MTP Amendment Map 2, which are incorporated herein by reference.

 

SECTION 2.

 

It is further provided that in case a section, clause, sentence or part of this Ordinance shall be deemed or adjudged by a Court of competent jurisdiction to be invalid, then such invalidity shall not affect, impair or invalidate the remainder of this Ordinance.

 

SECTION 3.

All ordinances or parts of ordinances in conflict herewith are specifically repealed.

 

SECTION 4.

 

That this Ordinance shall be in full force and effect from and after its passage and approval.
