Section 253.001 of the Texas Local Government Code states: "Land owned, held, or claimed as a public square or park may not be sold unless the issue of the sale is submitted to the qualified voters of the municipality at an election and is approved by a majority of the votes received at the election; provided, however, this provision shall not apply to the sale of land or right-of-way for drainage purposes to a district, county, or corporation acting on behalf of a county or district."
The City Council wishes to sell approximately 24 acres of park land situated at the northwest corner of State Highway 161 and Warrior Trail. Therefore, an election must be ordered so that the proposition can be submitted to voters at the November 3, 2015 special election. The election must be ordered at a regular meeting of Council no later than August 24.
Financial Consideration
The city will hold joint elections with entities located in Dallas, Tarrant and Ellis Counties. The election will be administered by the Elections Administrators of Dallas, Tarrant and Ellis Counties.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS CALLING A SPECIAL ELECTION TO BE HELD WITHIN THE CITY ON NOVEMBER 3, 2015, ON THE QUESTION OF AUTHORIZING THE SALE OF APPROXIMATELY 24 ACRES OF LAND WITHIN CENTRAL PARK LOCATED AT THE NORTHWEST CORNER OF STATE HIGHWAY 161 AND WARRIOR TRAIL; MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS RELATING THERETO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND PRAIRIE, TEXAS:
SECTION 1: An election shall be held on November 3, 2015, in the City of Grand Prairie, Texas, which date is a uniform election date pursuant to Texas, Election Code, Section 41.001, for the purpose of submitting the following measure:
PROPOSITION NUMBER 1
Shall the City Council of the City of Grand Prairie be authorized to sell approximately 24 acres of land within Central Park located at the northwest corner of State Highway 161 and Warrior Trail?
SECTION 2: Pursuant to an agreement between the City of Grand Prairie and the Dallas County Elections Department, Tarrant County Elections Department and the Ellis County Elections Department, the election shall be conducted by the Dallas County Elections Department, Tarrant County Elections Department and Ellis County Elections Department in precincts of the respective Counties within the City of Grand Prairie, in accordance with the provisions of the respective agreements (collectively, the “Agreements”).
On election day, the polls shall be open from 7:00 a.m. to 7:00 p.m.
SECTION 3: That early voting by personal appearance shall be conducted by the Dallas County Elections Department, Tarrant County Elections Department and the Ellis County Elections Department in accordance with provisions of the respective county agreements (collectively, the “Agreements”).

Application for early voting mail ballots by voters qualified to vote by mail shall be made as follows:
§ Dallas County voters may make application for mail ballots directly to the Dallas County Elections Administrator, 2377 N. Stemmons Freeway, Suite 820, Dallas, Texas 75207;
§ Tarrant County voters may make application for mail ballots directly to the Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas 76111.
§ Ellis County voters may make application for mail ballots directly to the Ellis County Elections Administrator, 106 S. Monroe, Waxahachie, Texas 75165
Applications for ballots by mail must be received no later than October 23, 2015.
SECTION 4: A voting system or systems meeting the standards and requirements of the Texas Election Code, as amended, is hereby adopted and approved for early voting by personal appearance and by mail and for election day voting.
Ballots shall be prepared in accordance with the Texas Election Code and permit electors to vote "FOR" or "AGAINST" the aforesaid measure which shall appear on the ballot substantially as follows:

SECTION 5: This election shall be held and conducted in accordance with the provisions of the Texas Election Code, and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish.
SECTION 6: Notice of the election shall be given in accordance with the provisions of the Texas Election Code, as amended.
SECTION 7: This ordinance shall incorporate the provisions of the Agreements, and to the extent of any conflict between this ordinance and the Agreements, the provisions of the Agreements shall control.

EL CONSEJO MUNICIPAL DE LA CIUDAD DE GRAND PRAIRIE, TEXAS, ORDENA LO SIGUIENTE:

SECCIÓN 4: Por la presente, se adopta y aprueba un sistema o sistemas de votación que cumplen con los estándares y requisitos del Código Electoral de Texas para la votación presencial anticipada, para la votación por correo postal y para la votación el día de elecciones.
Las boletas electorales se prepararán de acuerdo con el Código de Elecciones de los Códigos Comentados de Texas, y les permitirán a los electores votar “A FAVOR” o “EN CONTRA” de las medidas antes mencionadas, que se indicarán en la boleta electoral sustancialmente de la siguiente manera:

SECCIÓN 5: Esta elección se realizará de conformidad con las disposiciones de los Códigos Comentados de Texas, y según lo establezca la ley, todos los materiales y procedimientos relacionados con la elección se imprimirán tanto en inglés como en español.
SECCIÓN 6: La notificación de la elección se efectuará de conformidad con las disposiciones del Código Electoral de Texas, con sus modificaciones.
SECCIÓN 7: Esta ordenanza incorporará las disposiciones de los Acuerdos, y en la medida en que haya algún conflicto entre esta ordenanza y los Acuerdos, prevalecerán las disposiciones de los Acuerdos.
