Analysis

On May 19, 2009, the City of Grand Prairie approved the Geotechnical and Material Testing Services Fee Ordinance and Service Contracts. Private Developers in Grand Prairie are required to deposit the Geotechnical and Material Testing Fees up front to have a third party engineering consultant working for the City to perform this work. On City Capital Improvement Projects, the City would continue to incur the cost to have this work performed as part of the CIP project budget.

At the current time, the administrative work required for the private development projects has become a burden on both City field and office staff. Private development is slow to fund both initially and when additional testing is required beyond the original scope

The Developers were to pay the City of Grand Prairie based on the established Geotechnical and Material Testing fee to include a 5% contingency as escrow funding deposited directly to the Street Projects Fund (0701) to perform this work.  The City then paid the City contracted consultants directly from the developer’s escrow funds for the work performed.  Since this was a pass through cost, funds not used are reimbursed to the Developer; however, the developer was to compensate the City for any additional costs incurred.

With execution of this ordinance, Private Developers would be responsible for coordinating this work with a geotehcnical and material testing firm registered with the Texas Board of Professional Engineers and under the direction of a Professional Engineer Licensed in the State of Texas providing this service and paying their own geotechnical and material testing fees.

The City geotechnical and material testing contracts for Capital Improvement Projects were rebid by the purchasing department and pricing modified. New pricing has removed minimum requirements on multiple items going forward.

City staff is recommending amendment of the ordinance removing the requirement for private developments to fund material testing directly with the City of Grand Prairie and modifying the pricing for City capital improvement projects.

The was presented and approved by the City Council Development Committee on March 18, 2019.

Financial Consideration

Funding will be provided for the City capital improvements projects from the approved project budget.
