Title
Price Agreement for portable toilet rentals from United Rentals through a national interlocal agreement with TXMAS at an estimated annual cost of $45,000.00. This agreement will be for one year with the option to renew for one additional one year period totaling $90,000.00 if all extensions are exercised. Authorize the City Manager to execute the renewal options with aggregate price fluctuations of the lesser of up to $50,000 or 25% of the original maximum price so long as sufficient funding is appropriated by the City Council to satisfy the City's obligation during the renewal terms

Analysis
This contract will be for departments to utilize for the rental of portable toilets on an as needed basis.
Chapter 271.102 of the Local Government Code authorizes local governments to participate in a cooperative purchasing program with another local government or local cooperative organization. In lieu of competitive bidding, items and services may be purchased through such agreements as the agreements have already been bid by the sponsoring entity or agency. The City of Grand Prairie has master inter-local cooperative agreements with various entities including TXMAS.
The Texas Procurement and Support Services (TPASS) has established, as an alternative purchasing method, the use of Texas Multiple Award Schedule (TXMAS) contracts that have been developed from contracts awarded by the federal government or any other governmental entity of any state.
United Rentals, through their TXMAS contract offers equipment rentals, including portable toilets.
The TXMAS contract began November 1, 2018 and will expire October 21, 2019, with one available one-year extension.
Financial Consideration
The City spends an estimated $45,000.00 annually on portable toilet rentals. Payments for these items will be made from various departmental accounts budgeted for these items.
