Analysis
The owner has agreed to sell the permanent right-of-way of 43,670 square feet in exchange for surplus right-of-way of 25,832 square feet and a cash payment of $14,271. This dollar amount is in line with recent appraisals. It will expedite the acquisition of this parcel thus, avoiding condemnation costs and delays. This will also convey surplus property not needed by the City in the future.
The City, as part of the surplus tract, will keep a permanent drainage easement (containing 3,936 sf) along Roy Orr Blvd. and a temporary construction easement (containing 5,278 sf) which will expire after completion of the widening of West Oakdale. (See attached aerial)
Mr. Elmore is the only abutting property owner (fee owner) to this surplus property.
Staff recommends the sale and exchange of surplus right of way required for the widening and extension of West Oakdale to Roy Orr Blvd. from James (Jimmy) Elmore.
The City will pay all title insurance expenses and closing costs.
Financial Consideration
Funding for the Exchange of Surplus Right of Way - West Oakdale Extension, not to exceed $20,000, is available in the Street Capital Projects Fund (400192) WO #01406303 (Oakdale-Roy Orr to 161) 68091(Easement Title Purchase).
