Analysis
In an offer letter (see attached offer letter) dated August 18, 2015, the Texas Department of Transportation (TxDOT) has offered to buy 0.5659 of one acre as fee title and 0.0247 of one acre for drainage easements. These parcels are located on the south side of IH 30 and west of Belt Line Road. In order to accept this offer, the City must pass a resolution agreeing to the sale. The offer amount was prepared by a State certified appraiser which represents fair, reasonable and market value for the City’s interests. Any City ownership of oil, gas, and sulphur is not included in the sale.
This property is required for the construction of frontage roads by TxDOT. The project limits are from NW 7th Street to Belt Line Road on the south side of IH 30 (see attached TxDOT right of way map).
Passage of this resolution is required by TxDOT to give the City Manager or his delegate authority to the sign all required documents to complete the sale. It will provide TxDOT the required authorization to proceed with this purchase from the City. Conveyance of these properties will be by a Special Warranty Deed (designated as Parcel No. 5) for the fee parcel and Drainage Easement for Highway Purposes (designated as Parcels No. 5E, Parts 1 and 2).
Financial Consideration
$109,290 paid by TxDOT to be deposited to the Street Capital Projects Fund (400192).
