Renewal of Sanitary Sewer Overflow Initiative Agreement with TCEQ

Analysis
On October 12, 2006, the City entered into an agreement for the Sanitary Sewer Overflow Initiative with Texas Commission for Environmental Quality (TCEQ). In return for agreeing to perform certain upgrades over a 10 year period to the City's Sanitary Sewer System, the City would essentially receive some immunity from TCEQ fines for such overflows. This original agreement has now expired.
The City has performed well under the agreement and has avoided fines which would have likely been inevitable without this agreement (it is virtually impossible to prevent all overflows). Therefore, the City has been offered the opportunity to renew the agreement and staff recommends renewal. Copies of the old agreement and the renewal offer are attached. If the City Council agrees, the intent to renew will be sent to the TCEQ and a new agreement with details of the requirements will be sent for approval
Financial Consideration
There is no cost to enter into this agreement. However, we will need to perform certain additional studies, identify actions to improved the sanitary sewer system and follow through on such actions at a later date. Funding for these items will be from future budgets.
