Analysis
The Texas Lottery Commission (TLC) has notified the City that we must pass a resolution in order to continue receiving bingo prize fees, as required by House Bill 914 passed by the 86th Legislature. Currently non-profit charitable organizations conducting bingo collect a 5% fee on prizes awarded. Protions of these funds are sent to TLC, who in turn remits a pro rata share of the funds to local government at the end of each fiscal year. The City receives a share of the bingo prize fees because we chose to do so before September 1993. Effective January 1, 2020, HB914 includes another change regarding the collection and remittance of prize fees. The City will no longer receive its payment from TLC; instead, the organizations conducting bingo in the city will be responsible for sending us 50% of the prize fees they collect on a quarterly basis.

To collect these monies, the City will need to 1) approve continued receipt by a majority vote of this resolution; 2) notify TLC of the decision by November 1, 2019 and 3) notify each licensed organization within the city of the continued imposition of the fee.

Financial Consideration
This resolution protects approximately $20,000 to $25,000 in General Fund revenues. There will be additional administrative overhead to monitor the program.
