Analysis

On August 4, 2015 a developer agreement was approved by City Council (15-4824) for the construction of an oversized storm drain under SH303 in the not to exceed amount of $168,650.

 

Weeks-Robinson developed a 300,000 square foot building in an industrial park on SH303. The development encroached into the floodplain of the south branch of Cottonwood Creek.  The engineer of records, Pacheco Koch,  provided a floodplain development permit with a flood study.  This developer agreement allowed for the oversizing of the storm drain under SH 303 for the south branch of Cottonwood Creek to address the potential overtopping of SH303 at the 100 year storm event. This section of Cottonwood Creek under SH303 had been identified as an area that needs improvement to accommodate the 100 year storm and potential flooding. The total cost for the improvement was $727,640 and the City only participated in $168,650 of the funding. The balance of $558,990 was paid by the Developer.

 

During the construction process it was realized that additional work for the removal of silt in the existing box culverts would be necessary to provide for the efficient working of the existing culverts. This portion of the work is at the City's total cost. Staff is recommending this be done in conjunction with the developer's construction for both time and value reasons.

 

Financial Consideration

Funding for developer participation change order/amendment No. 1 in the amount of $34,328.88 is available in the Storm Drainage Capital Projects Fund (401592) WO #01604603 (FY16 Developer Participation) 68540 Construction.
