Analysis
Primos Food Mart requests a variance to the requirement that prepackaged alcohol sales occur at least 300 feet from the property line of a public school. The location, 207 Clarice Street, is approximately 200 feet east of the intersection of Clarice Street and SW 3rd Street. The property line of Bowie Elementary School is approximately 200 feet to the northwest as measured in a direct line from property line to property line. The proposed location for alcohol sales is accessible from Clarice Street and SW 3rd Street. Notice was sent by mail on February 2nd to property owners within 300 feet of the location, and staff reached out to the school by phone but to date has not received a response. No other responses have been submitted to the notices that were sent out.
As the attached exhibit A shows, the property line of the school at 425 Alice Drive extends to SW 3rd Street and runs south to a point approximately 120 feet from the northernmost leg of the SW 3rd Street and Clarice Street intersection. As part of the school expansion currently under construction, a drive access will be constructed from SW 3rd Street which is approximately 300 feet from the intersection. The building addition under construction is largely to the east of the current school building, approximately 450 feet from the intersection.
