Analysis

ITSO Vegan requests a variance to the requirement that alcohol sales occur at least 300 feet from the front door of a church. The location, 830 Mayfield Road, Suite 600, sits approximately 197 feet from the front door of Iglesia Casa de Gracia Church. Notice was sent by mail on December 20, 2018 to property owners within 300 feet of the location. No other responses have been submitted to the notices that were sent out.

 

Exhibit A shows the approximate location of the restaurant space. Though the restaurant is addressed from Mayfield Road, it faces Robinson Road and is buffered from the church by several other suites. The church faces Mayfield Road.  Based on these factors, staff believes that a sufficient buffer will be maintained between the two locations and has no objection to the variance request.
