Analysis
In an offer letters (see attached offer letters) dated February 12, 2016, the Texas Department of Transportation (TxDOT) has offered to buy 0.0291 of one acre as fee title, 0.0918 acre and 0.2197 acre as drainage easements from the south side of IH 20 along their project limits from SH 161 east to Carrier Parkway, Grand Prairie, Dallas County, Texas. These right of way parcels are required for the construction of frontage roads.
In order to accept this offer, the City must pass a resolution agreeing to the sale. The offer amount was prepared by a State certified appraiser which represents fair, reasonable and market value for the City’s interests. Any City ownership of oil, gas, and sulphur is not included in the sale. This property is required for the construction of frontage roads by TxDOT.
Passage of this resolution is required by TxDOT and their title company to give the City Manager, or his delegate, authority to the sign all required documents to complete the sale. It will provide TxDOT the required authorization to proceed with this purchase from the City. Conveyance of these properties will be by a Special Warranty Deed (designated as Parcel No. 11) for the fee parcel and Drainage Easement for Highway Purposes (designated as Parcels No. 8E and 9E).
