Analysis
Raising Cane’s Restaurants, L.L.C , a Louisiana limited liability company(the developer) and Epic West Towne Crossing LP, a Texas limited partnership (the property owner) have requested a license to allow for the encroachment on the City’s two platted drainage easements fifteen-feet wide each (See attached Exhibit “A” plat exhibit). Approval of this license agreement is required for construction of a Raising Cane’s restaurant at 3158 South SH 161.
As shown on the site plan, the retaining wall will span the drainage easements at two separate locations (See attached Exhibit “B” for site plan). The retaining wall will use a concrete beam to span the City’s drainage easement to reduce any load on the drainage pipes. The retaining wall will vary in height from 3.5 feet to 4.7 feet.
All public utilities have approved the encroachment. Engineering staff have reviewed the construction plans and recommend approval of the license. The license will have a 20-year term with either party having the right to terminate upon written notice.
Financial Consideration
Revenue: $500.00 which is the recommended one time only charge for the twenty-year term license in addition to the application fee of $100.
