Analysis

The city is installing a new wastewater line on Avenue K in order to provide additional needed wastewater capacity.  This pipeline route encroaches on the Union Pacific Railroad right-of-way and as such requires a license from the railroad.The purpose of the communication is to request authority to enter into the license agreement with the railroad.  The agreement requires the City to pay a one-time license fee of $12,900 and obtain Railroad Protective Liability Insurance.  Our insurance consultants are looking into the insurance requirements.

 

Financial Consideration

Funding for the Longitudinal Pipeline License Agreement with Union Pacific Railroad for Encroachment on the Railroad Right-of-Way, is available in the Wastewater Capital Projects Fund  (500692) WO #01410601-03 (Ave K to TRA Capacity Upgrade) ROW/Easements (68610).
