The Grand Prairie Police Department, when recruiting and hiring highly qualified police officers, must ensure that the physical fitness abilities of these perspective officers are at the highest level to meet the demands of the duties of law enforcement personnel. In order to ensure the physical fitness level of each individual meets the entrance level standards, the Police Department must develop a validated and legally defensible physical fitness entrance exam for applicants to avoid adversely impacting protected class applicants.
On May 4, 2004, the City of Grand Prairie and the City of Irving entered into an Interlocal Agreement pursuant to Texas Government Code 791 which authorizes the City to utilize all of Irving’s contracts. The City of Irving has recently entered into a contract with FitForce, Inc., “a national leader in physical readiness solutions for the public safety community since 1993.” The Police Department seeks to mutually share the consulting process with the City of Irving in preparing the standards for the physical fitness entrance exam.
Vernon’s Texas Statues and Codes Annotated (VTCA), Local Government Code 791, The Texas Interlocal Cooperation Act, provides that any one or more local governmental entities may contract with each other for the performance of governmental functions and for the joint use of facilities or services for police protection and for the promotion and protection of the health and welfare of the inhabitants of this State and the mutual benefit of the parties.
