Analysis
The abandonment applicant, Sargent Investments, LLC, has requested the abandonment of a 12-foot utility easement running through the middle of Block A, Lots 1 through 8, of the Cox and Hines Addition. The abandoned utility easement would be used in the future development of this property.

Staff has reviewed the requested abandonment and finds that the abandonment of 12-foot utility easement would not hinder drainage or utilities in the area.

AN ORDINANCE PROVIDING FOR ABANDONMENT OF AN UNNEEDED PUBLIC UTILITY EASEMENT IN THE COX AND HINES ADDITION TO THE CITY OF GRAND PRAIRIE, TARRANT COUNTY, TEXAS; PROVIDING FOR THE QUITCLAIM THEREOF TO SARGENT INVESTMENTS, LLC, THE FEE OWNER OF LOTS 1 THROUGH 8, BLOCK A, OF THE COX AND HINES ADDITION; PROVIDING FOR THE TERMS AND CONDITIONS OF THE ABANDONMENT AND QUITCLAIM MADE HEREIN; PROVIDING FOR THE INDEMNIFICATION OF THE CITY OF GRAND PRAIRIE AGAINST DAMAGES ARISING OUT OF THE ABANDONMENT HEREIN; PROVIDING FOR THE CONSIDERATION FOR THE ABANDONMENT; AND PROVIDING AN EFFECTIVE DATE FOR THE ORDINANCE

WHEREAS, the City Council of the City of Grand Prairie, acting pursuant to law and upon the request and petition of Sargent Investments, LLC, hereinafter referred to as GRANTEE, deems it advisable to abandon and quitclaim an unneeded public utility easement in the City of Grand Prairie, Tarrant County, Texas, more particularly described in “Exhibit A and B”, attached hereto and incorporated herein; and

WHEREAS, the City Council of the City of Grand Prairie is of the opinion that said public utility easement is not needed for public use, and same should be abandoned and quitclaimed; and
