Analysis
Property owners or their authorized representatives have refused to negotiate on the acquisition of required right of way. In order to maintain project momentum, these parcels must be condemned.
This resolution will authorize a specific determination that these parcels are necessary for this public use project as required by Senate Bill 18 passed September 1, 2011, in the event eminent domain action is required.
Financial Consideration
Funding for the cost for rights-of-way and easement acquisitions is available in the Street Capital Projects Fund (400192), WO #01907603 (Ragland Reconstruction (5 Lanes Concrete: 360 to Day Miar), (2 lanes Concrete: East past Church Entrance), (2 Lanes Asphalt East along new curve to Mirabella).
