The abandonment applicants, HSU & ASSOCATES, LLC, a Texas Limited Liability Company, have requested the partial abandonment of a utility easement located at 734 West North Carrier Parkway. The commercial building is encroaching into the platted utility easement. All public utility companies have agreed with the abandonment.

AN ORDINANCE PROVIDING FOR PARTIAL ABANDONMENT OF UNNEEDED PUBLIC UTILITY EASEMENT IN THE THIRD INSTALLMENT, INDUSTRIAL COMMUNITY NO. 5, SITE 1, BLOCK 1, GREAT SOUTHWEST INDUSTRIAL DISTRICT TO THE CITY OF GRAND PRAIRIE, TARRANT COUNTY, TEXAS; PROVIDING FOR THE HSU & ASSOCATES, LLC, A TEXAS LIMITED LIABILITY COMPANY, THE FEE OWNERS OF SAID PROPERTY CONVEYED BY SPECIAL WARRANTY DEED FILED MARCH 23, 2015, INSTRUMENT NUMBER D215057419; PROVIDING FOR THE TERMS AND CONDITIONS OF THE ABANDONMENT AND QUITCLAIM MADE HEREIN; PROVIDING FOR THE INDEMNIFICATION OF THE CITY OF GRAND PRAIRIE AGAINST DAMAGES ARISING OUT OF THE ABANDONMENT HEREIN; PROVIDING FOR THE CONSIDERATION FOR THE ABANDONMENT; AND PROVIDING AN EFFECTIVE DATE FOR THE ORDINANCE.
WHEREAS, the City Council of the City of Grand Prairie, acting pursuant to law and upon the request and petition of HSU & ASSOCATES, a Texas Limited Liability Company, hereinafter referred to as GRANTEE, deems it advisable to abandon and quitclaim a portion (six-inches) of an unneeded public utility easement in the City of Grand Prairie, Tarrant County, Texas, more particularly described in “Exhibit A”, attached hereto and incorporated herein; and
